What are the changes to the Seller Protocol Forms?

The Law Society has put in place that following the 15 January 2025 all conveyancing sale files must now use the updated protocol forms.

The changes have been widely regarded as unnecessary and put a higher onus on the seller to provide substantial information about the property.

What has changed?

The Property Information Form has more than doubled in size from 16 pages to 35 pages.

Including larger sections for information on electric charging vehicles, solar panels and disabled access. Further, the form asks that sellers provide further information that its traditionally covered by specialist searches.

Further large changes have been made to the Leasehold Information Form for the seller to provide further information on the Building Safety Act 2022. Information that most lay persons will not have in depth knowledge of.

Why have these changes been made?

The hopes of the changes are to encourage more transparency, minimising risk for purchasers and decrease the enquiries raised by buyers’ solicitors. With the idea being that estate agents will provide sellers with copies of the forms ahead of the property being sold subject to contract. Hoping to decrease transaction times.

However, conveyancers are sceptical of the changes deeming it as putting an unnecessary burden on sellers.

Only time will tell if the new forms are success.
